{"id":561,"date":"2023-02-11T02:24:06","date_gmt":"2023-02-11T02:24:06","guid":{"rendered":"https:\/\/edenreports.com\/?p=561"},"modified":"2023-02-11T02:24:07","modified_gmt":"2023-02-11T02:24:07","slug":"prepare-to-be-tracked-digital-real-ids-marked-with-a-gold-star-may-be-mandatory-soon-to-access-basic-necessities","status":"publish","type":"post","link":"https:\/\/edenreports.com\/index.php\/2023\/02\/11\/prepare-to-be-tracked-digital-real-ids-marked-with-a-gold-star-may-be-mandatory-soon-to-access-basic-necessities\/","title":{"rendered":"Prepare to be Tracked: Digital Real IDs Marked With a Gold Star May Be Mandatory Soon to Access Basic Necessities"},"content":{"rendered":"\n<p>The&nbsp;<a href=\"https:\/\/www.tsa.gov\/real-id\">2005 Real ID Act<\/a>, which&nbsp;<a href=\"https:\/\/www.nytimes.com\/2022\/12\/05\/travel\/real-id-deadline-delay.html\">requires<\/a>&nbsp;U.S. citizens to present more than just a basic driver&#8217;s license to board domestic flights, was initially scheduled to take effect on May 3, 2023.<\/p>\n\n\n\n<p>However, after&nbsp;<a href=\"https:\/\/www.nytimes.com\/2022\/12\/05\/travel\/real-id-deadline-delay.html\">many years of delays<\/a>, the Department of Homeland Security has&nbsp;<a href=\"https:\/\/www.nytimes.com\/2022\/12\/05\/travel\/real-id-deadline-delay.html\">postponed<\/a>&nbsp;the enforcement deadline by an additional two years.<\/p>\n\n\n\n<p>As a result, travelers will now have until May 7, 2025, to obtain the necessary updated documents.<\/p>\n\n\n\n<p>The Real ID was a&nbsp;<a href=\"https:\/\/www.nytimes.com\/2022\/12\/05\/travel\/real-id-deadline-delay.html\">response<\/a>&nbsp;to the recommendations made by The 9\/11 Commission.<\/p>\n\n\n\n<p>Officially, this Act&nbsp;<a href=\"https:\/\/www.nytimes.com\/2022\/12\/05\/travel\/real-id-deadline-delay.html\">aimed to enhance<\/a>&nbsp;the security and accuracy of state-issued identification documents through collaboration between the states and the federal government.<\/p>\n\n\n\n<p>REAL ID-compliant cards are&nbsp;<a href=\"https:\/\/www.tsa.gov\/real-id\">marked&nbsp;with a gold star<\/a>&nbsp;at the top&nbsp;of the card.<\/p>\n\n\n\n<p>Soon, a Real ID may be&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/official-purposes-of-the-real-id-act-2005-explained-by-constitutional-alliance\/\">mandatory<\/a>&nbsp;for boarding a commercial flight. The Real ID may also be a&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/official-purposes-of-the-real-id-act-2005-explained-by-constitutional-alliance\/\">requirement<\/a>&nbsp;for accessing secure buildings, though the specific locations have&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/official-purposes-of-the-real-id-act-2005-explained-by-constitutional-alliance\/\">not been specified yet<\/a>. It could range from Capitol buildings to public schools, and even public gathering places.<\/p>\n\n\n\n<p>The REAL ID Act, which was introduced in the&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2008-01-29\/html\/08-140.htm\">Federal Register<\/a>&nbsp;on January 28, 2008, sparked&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2008-01-29\/html\/08-140.htm\">widespread concern<\/a>&nbsp;with over 21,000 comments posted in response.<\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/official-purposes-of-the-real-id-act-2005-explained-by-constitutional-alliance\/\">overarching fear<\/a>&nbsp;was that the program, despite its initially good intentions, could become a tool for&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">surveillance and tracking<\/a>, holding sensitive personal information and records for each individual in a national digital identity database.<\/p>\n\n\n\n<p>Some comments&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">warned<\/a>&nbsp;that the REAL ID could become a&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">mandatory requirement<\/a>&nbsp;for all aspects of American life, with potential consequences beyond its original purpose, including control over gun ownership and marijuana use.<\/p>\n\n\n\n<p>The ID&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">could be necessary<\/a>&nbsp;for everyday tasks such as air travel, banking, and accessing government benefits like Social Security and Medicaid.<\/p>\n\n\n\n<p>The former Secretary of the Department of Homeland Security wrote an&nbsp;<a href=\"https:\/\/epic.org\/wp-content\/uploads\/privacy\/id_cards\/epic_realid_0508.pdf\">opinion column<\/a>, in which they stated that after the final rule was published, &#8220;embracing REAL ID&#8221; would allow it to be utilized for&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">various activities<\/a>&nbsp;such as cashing a check, hiring a babysitter, boarding a plane, and many more.<\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">concern was also raised<\/a>&nbsp;that the ID card could create a divide between those who possess it and those who don&#8217;t, leading to mistrust and suspicion towards the latter group.<\/p>\n\n\n\n<p>Here are some of the main concerns people have raised about the mass adoption of Real ID:<\/p>\n\n\n\n<p>1.&nbsp;<strong>It uses advanced facial recognition technology<\/strong><\/p>\n\n\n\n<p>The REAL ID Act&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">grants permission<\/a>&nbsp;for facial recognition technology to be utilized and leaves room for further &#8220;future requirements&#8221; to be imposed.<\/p>\n\n\n\n<p>This could entail the&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">collection of sensitive information<\/a>&nbsp;such as DNA samples, retinal scans, or even RFID chips that monitor Americans&#8217; movements.<\/p>\n\n\n\n<p>The legislation is written in a manner that&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">enables<\/a>&nbsp;authorities to demand that citizens obtain a Real ID, and then later demand&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">additional requirements<\/a>&nbsp;in order to maintain it.<\/p>\n\n\n\n<p>To obtain your REAL ID license, you must&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">undergo<\/a>&nbsp;a photo capture using facial recognition technology. The Bureau of Motor Vehicles will scan and store your certified birth certificate and original social security card in their database for&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">seven years<\/a>. Unfortunately, due to the current state of cyber security, we&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">cannot guarantee<\/a>&nbsp;the security of this newly established database.<\/p>\n\n\n\n<p>Before the Real ID Act, many states and territories&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">relied<\/a>&nbsp;on low-resolution, analog photographs for driver&#8217;s license applications. These photographs were&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">not suitable<\/a>&nbsp;for facial recognition software due to their high error rate and low resolution. However, they were still recognizable by the human eye.<\/p>\n\n\n\n<p>Today,&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">roughly 35 states<\/a>&nbsp;have implemented facial recognition technology, which maps the face by measuring the distances between key facial features. This technology is&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">based on the premise<\/a>&nbsp;that these distances are unique to each individual, similar to the uniqueness of one&#8217;s fingerprints.<\/p>\n\n\n\n<p>Facial recognition technology uses&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">mapping<\/a>&nbsp;to identify an individual by measuring the distinct distances between key facial features, such as the eyes, nose, ears, and lips. This mapping process is&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">based on the belief<\/a>&nbsp;that the distances between these features are unique to each person, just as fingerprints are considered to be unique identifiers.<\/p>\n\n\n\n<p>2.&nbsp;<strong>The Real ID Act demands state DMV database linking<\/strong><\/p>\n\n\n\n<p>The implementation of REAL ID creates a&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">connected network<\/a>, giving other states&#8217; motor vehicle departments and the federal government&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">access<\/a>&nbsp;to every Bureau of Motor Vehicles database.<\/p>\n\n\n\n<p>With just a simple change in regulations, the federal Department of Homeland Security could&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">effortlessly link<\/a>&nbsp;all 50 states&#8217; databases, leading to the creation of a&nbsp;<a href=\"https:\/\/www.themainewire.com\/2017\/04\/real-id-dangerous-id\/\">national identity database<\/a>, without the need for any action from Congress.<\/p>\n\n\n\n<p>Database linking&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">increases the likelihood<\/a>&nbsp;of individuals becoming victims of identity theft.<\/p>\n\n\n\n<p>3.&nbsp;<strong>The Real ID Act grants the Department of Homeland Security (DHS) unprecedented authority<\/strong><\/p>\n\n\n\n<p>It empowers the Secretary of DHS to&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">unilaterally determine<\/a>&nbsp;the circumstances under which citizens must present a Real ID-compliant driver&#8217;s license as proof of identification for &#8220;Official Purposes.&#8221;<\/p>\n\n\n\n<p>The Real ID Act outlines&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">three official purposes<\/a>, but the Secretary of DHS is granted the authority to expand the list&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">without seeking approval<\/a>&nbsp;from Congress.<\/p>\n\n\n\n<p>This&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">unchecked power<\/a>&nbsp;gives the Secretary the ability to&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">add requirements<\/a>&nbsp;such as having a Real ID-compliant driver&#8217;s license to purchase a weapon or ammunition, or even to pick up a prescription.<\/p>\n\n\n\n<p>This&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">unrestricted discretion<\/a>&nbsp;granted to the Secretary&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">raises concerns<\/a>&nbsp;about its constitutionality, as nowhere in the Constitution does it give such broad powers to the Executive Branch, especially to a cabinet member.<\/p>\n\n\n\n<p>4.&nbsp;<strong>The MRZ (Machine Readable Zone) of a Real ID-compliant driver&#8217;s license is unencrypted<\/strong><\/p>\n\n\n\n<p>During the rulemaking process of the Real ID Act,&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">privacy advocates argued<\/a>&nbsp;that the Machine Readable Zone (MRZ) should be encrypted to&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">protect citizens&#8217; information<\/a>.<\/p>\n\n\n\n<p>However, the DHS&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">believed<\/a>&nbsp;that encryption would pose technical difficulties for law enforcement officers in the field.<\/p>\n\n\n\n<p>It has become&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">evident<\/a>&nbsp;that the unencrypted MRZ is a&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">serious problem<\/a>&nbsp;that may cause harm to citizens.<\/p>\n\n\n\n<p>Criminals and retailers&nbsp;<a href=\"https:\/\/constitutionalalliance.org\/real-id-exposed-it-is-worse-than-you-think\/\">could take advantage<\/a>&nbsp;of the unencrypted MRZ on driver&#8217;s licenses for illegal activities.<\/p>\n\n\n\n<p>While the deadline keeps getting pushed back, the Real ID is becoming closer to being a reality.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The&nbsp;2005 Real ID Act, which&nbsp;requires&nbsp;U.S. citizens to present more than just a basic driver&#8217;s license to board domestic flights, was initially scheduled to take effect on May 3, 2023.
